1. INTRODUCTION
Welcome to Collectibol, a digital football-themed collecting app developed and operated by Algoritcom Games S.L., with VAT ID B70779715 and registered address at C/ Muntaner, 479, 6º 4ª, 08021 Barcelona, Spain. These Terms govern access, use, registration, participation, in-app purchases, promotions, data protection, liabilities, and other legal aspects related to the Collectibol app, and constitute a legally binding agreement between the user and Algoritcom Games S.L. User: any natural person who accesses, registers, or uses the app, either directly or, in the case of minors, through the consent and supervision of their legal guardian. By accessing, registering, or using Collectibol, you acknowledge that you have read, understood, and expressly accepted these Terms, as well as our Privacy Policy. If you do not agree, please refrain from using the app.
2. USAGE REQUIREMENTS AND ACCOUNT REGISTRATION
2.1 Minimum Age and Parental Consent To use Collectibol, you must be at least 14 years old, unless your country's law establishes a different minimum age pursuant to Art. 8 of Regulation (EU) 2016/679 (GDPR). This age has been set in the best interest of minors and due to the nature of the app. In countries where the minimum age is higher, prior and verifiable parental consent will be required in accordance with Art. 7 GDPR. Verification mechanisms may include: • Double email confirmation (double opt-in) • Upload of a document proving the guardian/minor relationship • Digital signature of the consent Documentary proof of consent will be retained for audit purposes. If false age declarations or manipulation of consent are detected, the account will be deleted, and the legal guardian will be notified if applicable. 2.2 Account Creation and Security The user agrees to: • Provide truthful, accurate, and up-to-date information • Maintain the confidentiality of their credentials • Not share their account or create multiple profiles without authorization Any unauthorized use must be reported immediately to: support@collectibol.com 2.3 Account Suspension and Cancellation Algoritcom Games S.L. may suspend or delete accounts, without compensation, in the event of: • Breach of these Terms or the Privacy Policy • Use of offensive language, cheating, bots, impersonation, or inappropriate content • Access from countries where use is legally restricted You may request account deletion at any time by writing to support@collectibol.com. This action is irreversible and will result in the loss of your virtual items and app progress.
3. APP FEATURES
3.1 Digital Packs Up to 2 free packs per day. Additional packs via virtual coins, missions, or promotions. Virtual coins can be obtained by completing missions or through in-app purchases. These coins are non-refundable and cannot be exchanged for real money. Rarities: Common, Rare, Epic, Legendary, and Mythical. 3.2 Grading and Effects System Preservation scale from 0.1 to 0.0001 (lower is better). Some cards have special visual effects. 3.3 Challenges and Rewards Weekly challenges with exclusive cards and real rewards. Physical prizes are subject to availability, tax regulations, and minimum age. Algoritcom Games S.L. reserves the right to request documentation to verify the identity and age of the winner before delivering the prize. Important legal note: Some physical prizes may be subject to taxes, customs duties, or fees according to the winner's local laws. The user is solely responsible for these costs. By participating in a challenge or giveaway with a physical prize, the user accepts this condition as a requirement for receiving the prize. 3.4 Social Interaction Secure card trading within the app. Customizable profiles and privacy settings.
4. PURCHASES, LICENSES, AND SUBSCRIPTIONS
4.1 Virtual Items and License Virtual items hold no real economic value and do not represent ownership. The user obtains a personal, limited, revocable, non-transferable license for use. Cards are not digital assets, blockchain elements, or NFTs. Usage or resale outside the app is prohibited. 4.2 Right of Withdrawal According to Art. 103.m of Royal Legislative Decree 1/2007, the right of withdrawal does not apply once digital content has been accessed, provided express consent has been given and the user has been informed of the loss of this right. 4.3 Refunds Refunds are not guaranteed except in the case of verifiable technical errors or duplication. Each case will be evaluated in accordance with applicable consumer regulations. 4.4 Subscriptions Automatic renewal unless canceled. Cancelable via App Store, Google Play, or by email. Partial refunds for already used periods are not guaranteed.
5. PROHIBITED CONDUCT
The following are strictly prohibited: • Using the app for illegal or fraudulent purposes • Manipulating data or impersonating identities • Uploading offensive, illegal, or unauthorized third-party content • Using bots, hacks, or external economies • Trading cards outside authorized channels
6. PROMOTIONS AND PRIZES
6.1 Participation and Acceptance of Terms The Collectibol app may occasionally organize promotions, challenges, or giveaways, either within the platform or via social media or other channels. Participation in any promotion implies full and unconditional acceptance of its specific Legal Terms and Conditions, which will be made available at the time of the promotion. These terms will detail participation requirements, winner selection criteria, prize descriptions, and additional conditions. Important: Employees of Algoritcom Games S.L. and their immediate family members may not participate, unless stated otherwise in the specific Legal Terms. 6.2 Geographic and Age Limitations Some prizes may be restricted to certain geographical areas due to legal, logistical, or fiscal reasons. Algoritcom Games S.L. reserves the right to exclude countries or regions from a promotion if prize delivery or legal compliance cannot be guaranteed. A minimum age may also be required to participate in specific giveaways, especially when the prize is physical, monetary, or promotional. 6.3 Winner Selection and Communication Winners will be selected according to the criteria stated in the Legal Terms (e.g., random draw, activity ranking, jury selection, etc.). Once selected, they will be contacted within 15 business days using the contact information provided in their account (email, SMS, or WhatsApp). Consent will always be requested beforehand. To receive the prize, the user must: • Confirm their personal details • Provide an ID document if required to verify age or identity • Expressly accept the tax and logistical conditions of the prize If the winner does not respond within 7 calendar days or declines the prize terms, the next selected user will be contacted. 6.4 Delivery of Physical Prizes Physical prizes will be shipped within 30 days from confirmation of the winner’s details. Prizes will be sent to the address provided by the winner, provided there are no shipping or customs restrictions in their country. Algoritcom Games S.L. is not responsible for delays, losses, or damages caused during shipping if the courier service was properly contracted. 6.5 Tax and Customs Conditions Legal note: Some physical prizes may be subject to customs duties, taxes, or local charges in the winner’s country. The user will be solely responsible for any applicable costs. Algoritcom Games S.L. will not cover any costs beyond the shipping of the prize as described in the Legal Terms. 6.6 Non-Exchangeable Prizes Prizes, whether physical or digital, cannot be exchanged for cash unless expressly stated otherwise. Prizes are personal and non-transferable and may not be assigned to third parties.
7. INTELLECTUAL PROPERTY
All content is the property of Algoritcom Games S.L. or authorized third parties. Reproduction, modification, or commercial use without prior written consent is prohibited. 7.1 Ownership of Rights All content available in the Collectibol app, including but not limited to: • Digital card designs, illustrations, animations, visual and audiovisual effects • Texts, descriptions, scripts, and narrative elements • Interface graphics, navigation structure, source code, databases • Logos, icons, sounds, and music • Functionalities, game mechanics, and challenge structures is the exclusive property of Algoritcom Games S.L., or used under express license from legitimate third-party rights holders. Such content is protected under national and international intellectual property laws, including the Spanish Intellectual Property Law, the Berne Convention, and other applicable regulations. 7.2 Limited Use License The use of the app by the user does not grant any intellectual or industrial property rights over the accessible content. Algoritcom Games S.L. grants the user a personal, limited, non-exclusive, revocable, non-transferable, and non-sublicensable license to use the app and its features according to these Terms and Conditions. The following actions are strictly prohibited: • Copying, modifying, distributing, publishing, adapting, translating, or creating derivative works from the app’s content without express written consent • Extracting or reusing substantial parts of the app’s database or internal content (e.g., data scraping) • Using the app’s content for commercial, promotional, or resale purposes, whether inside or outside the Collectibol environment • Using bots to collect visual elements, cards, or other digital assets 7.3 Third-Party Content Some content may have been developed by collaborators, designers, graphic artists, or third-party providers under contract or rights assignment. Such elements remain protected by the respective authors’ rights and are used under express authorization. If you believe any content in the app infringes your intellectual property rights, you may notify us at: support@collectibol.com with documented proof of ownership. 7.4 Infringements Unauthorized use of protected content may constitute an infringement of intellectual and industrial property rights and may result in legal action, including civil, administrative, or criminal liability.
8. LIABILITY, LIMITATIONS, AND INDEMNITY
8.1 Scope The app is provided “as is” and “as available.” We do not guarantee the absence of errors or uninterrupted service. 8.2 Limitation of Liability We are not liable for: • Device or connectivity failures • Data loss due to misuse • User-generated content • Decisions made based on the game Collectibol is not an investment platform. Nothing in these Terms shall limit the liability of Algoritcom Games S.L. in cases where it cannot be legally limited under applicable law. 8.3 International Use Use outside Spain is subject to local laws, unless they contradict mandatory EU regulations. We do not guarantee legal compliance outside the EU. 8.4 Indemnity Clause The user agrees to indemnify and hold harmless Algoritcom Games S.L. from any damages or harm resulting from misuse of the app, violation of these Terms, or infringement of third-party rights.
9. COMMUNICATIONS AND ADVERTISING
9.1 Operational Communications Algoritcom Games S.L. may send you communications related to the operation of the Collectibol app, including: • Registration confirmations or account updates • Notifications about challenges, prizes, or your packs/cards • Security updates, changes to the Terms and Conditions or Privacy Policy • Important notices about service interruptions, technical issues, or maintenance These communications are necessary for the proper functioning of the app and cannot be disabled while the account is active. 9.2 Commercial and Promotional Communications We may send you promotional messages related to Collectibol if you have given your express consent upon registration or at any later time. These messages may include: • News about new clubs added to the app • Information about giveaways, exclusive promotions, challenges, or special events 9.4 Right to Object and Unsubscribe You may withdraw your consent or unsubscribe at any time, without providing justification. To do so, you may: • Click the “Unsubscribe” link or similar in all promotional emails • Configure your preferences in your app profile (if this feature is enabled) • Write directly to: support@collectibol.com Unsubscribing will be processed within a maximum of 48 hours from receipt. 9.5 No Third-Party Data Sharing for Advertising Purposes Your personal data will never be shared with third parties for commercial or advertising purposes without your specific and express consent. Algoritcom Games S.L. commits to using your data solely for purposes related to the Collectibol app and in accordance with the Privacy Policy.
10. DATA PROTECTION

11. GOVERNING LAW AND JURISDICTION
11.1 Applicable Law These Terms and Conditions, as well as any disputes arising in connection with the use of the Collectibol app (access, usage, interpretation, enforcement, validity, or breach), shall be governed by the laws of Spain, in particular: • The Spanish Civil and Commercial Codes • Royal Legislative Decree 1/2007 (Consumer Protection Act) • Regulation (EU) 2016/679 (GDPR) • Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE) • Any other applicable European legislation Notwithstanding the above, if the user qualifies as a consumer under their national legislation, any mandatory consumer protection rules of their country of residence will also apply. 11.2 Jurisdiction Any dispute related to the use of the app shall be submitted to the Courts and Tribunals of the city of Barcelona (Spain), unless a mandatory jurisdiction applies under consumer protection regulations. 11.3 Consumer Rights Nothing in these Terms shall limit, exclude, or modify any non-waivable statutory rights you may have as a consumer under your national laws. If you reside outside of Spain, you may still file complaints or take legal action in your habitual country of residence if permitted under applicable consumer protection laws. 11.4 Alternative Dispute Resolution In accordance with Regulation (EU) 524/2013 on online dispute resolution, we inform you of the European ODR platform: 🔗 European Commission ODR Platform This platform allows consumers and traders to resolve disputes related to online purchases or services without going to court. Algoritcom Games S.L. is not obliged but is open to voluntarily participating in such procedures with accredited bodies.
12. CHANGES TO THE TERMS
We reserve the right to modify these Terms. You will be notified in advance via email or within the app. Continued use after changes implies acceptance. 12.1 Right to Modify Algoritcom Games S.L. reserves the right to modify, update, or replace these Terms and Conditions of Use in whole or in part at any time, provided there are valid reasons, such as: • Changes in applicable laws or case law • Introduction of new features, game modes, or services within the app • Operational, security, or user experience improvement needs • Technical or commercial updates • Changes in third-party platform conditions (App Store, Google Play, etc.) 12.2 User Notification Any significant modification will be communicated to users with reasonable advance notice before it takes effect, through: • Notification within the app (banner, pop-up, login message, etc.) • And/or communication by email to the address provided during registration 12.3 Acceptance of New Terms Continued use of the Collectibol app after the new Terms come into effect implies the user's express acceptance. If the user disagrees with the changes, they may stop using the app and request deletion of their account and associated personal data, in accordance with the Privacy Policy.
13. ENTIRE AGREEMENT CLAUSE
These Terms constitute the entire agreement between the user and Algoritcom Games S.L. and supersede any prior agreements related to the app. 13.1 Entire Agreement These Terms and Conditions of Use, along with the Privacy Policy and any specific Legal Terms for promotions or giveaways, constitute the complete and exclusive agreement between the user and Algoritcom Games S.L. regarding the use of the Collectibol app. This agreement replaces and nullifies any other agreement, communication, proposal, understanding, negotiation, or prior statement—whether verbal or written—related to the app or the services provided through it. 13.2 No Reliance on External Representations By accepting these Terms, the user acknowledges and agrees that: • They have not relied on any statement, promise, or guarantee not expressly contained in this document • They may not invoke previous communications with Algoritcom Games S.L. personnel (e.g., via social media, email, or customer support) as part of the contract unless expressly included in these Terms 13.3 Prevalence of These Terms In case of conflict between these Terms and any other document, information, or communication published on the app, social media, or promotional channels, the provisions of this document shall prevail unless explicitly stated otherwise by Algoritcom Games S.L.
